These terms apply to the Canopy iPhone app and this website. By using Canopy, you agree to them and to Apple's applicable App Store terms.

Using Canopy

Canopy gives you a personal, limited, non-exclusive, non-transferable right to use the app for ordinary private listening, subject to these terms and the rules of the App Store through which you obtained it.

You may not copy, extract, redistribute, sell, reverse engineer, or separately exploit Canopy's software or bundled recordings except where applicable law expressly permits it. You may not use Canopy to infringe another person's rights or interfere with the app, website, or their infrastructure.

Wellness disclaimer

Canopy is a wellness and ambient-audio product. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease, mental-health condition, or other condition.

Do not use Canopy as a substitute for professional medical advice, diagnosis, or treatment. If you are experiencing an emergency or need medical support, contact an appropriate professional or emergency service.

Use audio at a safe level and remain aware of your surroundings. Do not use Canopy where reduced attention could create a risk, including while driving or operating machinery.

Software, artwork, and recordings

Canopy's software, design, name, artwork, and original content are protected by applicable intellectual-property laws. Third-party bird recordings remain subject to their respective licenses and attribution requirements.

Public recording provenance and license links are listed on the Recording Credits page. Those credits do not grant permission to extract recordings from the app or bypass the terms of their original sources.

Availability and changes

Canopy may change, add, or remove features, soundscapes, or supported operating-system versions. We may suspend the website or app distribution for maintenance, security, legal, or operational reasons. We do not promise that every feature will always be available or error-free.

Updates may be required to continue using Canopy. App Store availability may vary by country, device, or Apple account.

Feedback and support

You may send feedback or support requests voluntarily. You keep ownership of your original feedback, but grant permission to use it without payment to improve Canopy. Do not include confidential information or material you do not have permission to share.

Responsibility and warranties

To the extent permitted by law, Canopy is provided “as is” and “as available,” without warranties beyond those that cannot legally be excluded. You are responsible for choosing a safe listening level and for how and where you use the app.

To the extent permitted by law, Canopy and its operator will not be liable for indirect, incidental, special, consequential, or punitive loss arising from use of, or inability to use, the app or website. Nothing here limits rights or liability that applicable law does not allow us to limit.

Apple

Apple is not responsible for Canopy or its content, support, maintenance, or claims relating to the app, except as required by Apple's own terms or applicable law. Apple and its subsidiaries may enforce App Store-related provisions of these terms as third-party beneficiaries where applicable.

Changes to these terms

These terms may be updated as Canopy changes. The effective date above will be revised when that happens. Continued use after an update means the revised terms apply, subject to any notice or consent required by law.
